WILDBELLY FERMENTATION FESTIVAL PARTICIPANT RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK AGREEMENT & PHOTO/VIDEO RELEASE WAIVER

This Release, Waiver of Liability, and Assumption of Risk Agreement ("Agreement") is entered into by the undersigned participant ("Participant") in connection with attendance at and participation in the WildBelly Fermentation Festival (the "Event"), including all activities, tastings, demonstrations, workshops, vendor interactions, and programming associated therewith (collectively, the "Activities").
The Event is organized by Wildbelly Fermentation Fest, and is a Program of Onward! A Legacy Foundation, located at 33 N. Chestnut St. Cortez, CO 81321 ("Organizer").
- ASSUMPTION OF RISK
Participant acknowledges and understands that participation in the Activities involves inherent risks, dangers, and hazards, including but not limited to:
- Consumption of fermented foods and beverages, which may contain live cultures, histamines, or allergens that may cause adverse reactions in some individuals;
- Exposure to equipment, machinery, glassware, and tools used in fermentation processes;
- Slip, trip, and fall hazards in indoor festival environments;
- Adverse reactions, illness, or injury arising from tasting or consuming unfamiliar fermented products;
- Interactions with other attendees, vendors, or members of the public;
Participant expressly acknowledges that these risks may result in personal injury, illness, property damage, or death. Participant voluntarily and knowingly assumes all such risks.
- RELEASE AND WAIVER OF LIABILITY
In consideration of being permitted to participate in the Event, Participant, on behalf of themselves and their heirs, personal representatives, and assigns, hereby releases, waives, discharges, and covenants not to sue the Organizer, its officers, directors, employees, volunteers, vendors, sponsors, partners, agents, and representatives (collectively, "Released Parties") from any and all claims, demands, damages, losses, causes of action, or liability of any kind arising out of or related to Participant's attendance or participation in the Event or Activities, including claims arising from the negligence of the Released Parties, to the fullest extent permitted by applicable law.
- FERMENTED PRODUCTS
Participant acknowledges that fermented foods and beverages may contain allergens, including but not limited to gluten, sulfites, dairy, and tree nuts. It is the Participant's sole responsibility to inquire about ingredients and to avoid products that may cause an allergic or adverse reaction.
- INDEMNIFICATION
Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Participant's participation in the Event; (b) Participant's breach of this Agreement; or (c) any act or omission of Participant that causes injury or harm to any third party.
- MEDICAL AUTHORIZATION
In the event of an emergency, Participant consents to receive medical treatment deemed necessary by emergency medical personnel. Participant acknowledges that the Organizer is not responsible for any medical expenses incurred as a result of such treatment.
- PHOTO AND MEDIA RELEASE
Participant grants the Organizer permission to photograph, film, or otherwise record Participant's image, likeness, and voice during the Event, and to use such recordings for promotional, educational, or commercial purposes without compensation to Participant.
- SEVERABILITY
If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
- GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.
